CLUB TERMS AND CONDITIONS

1. Introduction
1.1 Welcome to the Demons and Thieves Club. It is owned and operated by LP Berger trading as “Adventure Parties and Publishing”. Our trading address is Allendale, Vale Road, Weybridge, Surrey KT13 9NW. Our other contact details are specified on our website.
1.2 Please read these terms and conditions (T&Cs) carefully. They cancel and replace any previous versions. By registering as a member or using this website you agree to be bound by these T&Cs.
2. Definitions
2.1 When we refer to “Member” or “you” in these TCs, we mean a registered user of our Club. “Club” includes both our website and our related services. And “Content” covers all information (including images, photos, forum posts) which you send in connection with the Club.
3. A note about users under 13
3.1 If you are 12 or under, you must not join the Club direct but instead please fill in the form to get permission from your parent / guardian.
4. Changes to the T&Cs
4.1 We may change these T&Cs by posting the revised version on our website for a reasonable period before they become effective. Please check our website from time to time. You will be bound by the revised agreement if you continue to use our website or services thereafter.
5. Use of our Club
5.1 We decide who may or may not become a Member.
5.2 You must comply with the rules of the Club:
• Don’t provide us with information which is untrue or misleading.
• Don’t break any laws or harm other peoples’ rights.
• Don’t provide any Content which involves swearing or bullying or which is untrue, offensive, unpleasant or rude or which refers to drugs / alcohol or sexual or racial issues or other inappropriate subjects.
• Don’t reveal through the Club (including in usernames) any information that enables you or anyone else to be identified or contacted including name, address, email, phone number, school etc.
• Don’t provide links to third party websites which are illegal or inappropriate.
• Don’t use the Club for any business.
• Don’t do anything which may disrupt the Club including worms, viruses etc.
• Don’t try and contact other Members directly, unless they are already friends of yours. You may interact through ‘Comments’ under ‘Posts.’
5.3 We reserve the right to check or monitor all Content and to reject, amend or remove it if it breaks our T&Cs or it is necessary to protect us or others or if we are required to do so legally.
5.4 We ask our Members to use Content only for genuine private, non-commercial purposes but, in case they don’t comply, you shouldn’t provide any Content if you are worried that it may be misused by others.
5.5 Please tell us immediately if you become aware of any inappropriate Content or inappropriate behaviour by any other Member. You can do this by emailing us at info@demonsandthieves.com.
5.6 You are responsible for third parties who use your account or identity (unless and to the extent that we are at fault).
5.7 You must take reasonable care to protect your password. Tell us immediately if you think that there has been a breach of security.
5.8 We may need to delete your Content (eg for reasons of space) so take a backup copy if you want to preserve it.
6. Cancellation
6.1 You may at any time cancel your registration with us by emailing info@demonsandthieves.com.
6.2 We may at any time cancel your registration for or use of our Club for any reason. If so, you must not attempt to re-register.
6.3 We cannot be held legally responsible for loss or damage resulting from cancellation of your registration for or of use of our Club provided we act in accordance with this agreement.
6.4 If we have given notice of cancellation in accordance with these T&Cs, you must not attempt to re-register for or use our Club.
7. Availability of our site
7.1 We will do our best to maintain the operation of our site and to rectify faults if they occur but we cannot guarantee that it will be uninterrupted or error-free. We may have to suspend the site for repair, maintenance, improvement or other technical reason.
8. Third party websites
8.1 We may link to third party websites which may be of interest to you. We do not recommend or endorse those sites or the products or services which they offer nor are we legally responsible for them as they are outside our reasonable control. You use such third party sites at your own risk.
9. Intellectual property rights
9.1 All trade marks, logos, graphics, images, photographs, animation, videos, text and software used on the Club are our intellectual property or that of our partners or Members. You may use it only for genuine, private, non-commercial purposes.
9.2 If you submit any Content to us for publication on our site or for competitions, you give us permission to publish this material on the site for as long as we wish and to alter or adapt it if we think necessary.
10. Our responsibility to you
10.1 You must give us a reasonable opportunity to remedy any matter for which we are liable before you incur any costs remedying the matter yourself.
10.2 We are not responsible for any loss or damage where:
10.2.1 there is no breach of a legal duty of care owed to you by us or by any of our employees or agents;
10.2.2 such loss or damage was not reasonably foreseeable by both parties;
10.2.3 such loss or damage is caused by you, for example by not complying with this agreement; or
10.2.4 such loss or damage relates to a business.
11. Your responsibility to us
11.1 You will be responsible to us for any loss or damage we suffer arising from your breach of this agreement.
12. General
12.1 These T&Cs shall be governed by English law and any disputes will be decided only by the courts of the United Kingdom.
12.2 If any part of these T&Cs is deemed ineffective for any reason, the remainder shall continue in full force. Headings above are for information only and are not binding.
12.3 A person who is not a party to this agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement.
12.4 Neither party is liable for failure to perform or delay in performing any obligation (excluding payment) under this agreement if the failure or delay is caused by any circumstances beyond its reasonable control.

2. What’s the point of this policy?
2.1 The idea is that we tell you how we deal your “personal information”. (This is the technical term for information which can be used to identify people). Please read on to find out what kinds of personal information we collect, how we use and protect it, to whom we disclose it and how you can access and rectify it.
2.2 We want you to feel comfortable with what we do. So much so that we don’t agree to you using our site unless you are completely happy with this policy. If you do use our site, we’ll assume that you do accept the policy.
3. What personal information do we collect?
3.1 If you apply to join the Demons and Thieves Club, and are under 13, we will collect your first name, your date of birth, the name of your parent / guardian and their email address. This is only so we can send your parent / guardian an email asking for their permission for you to join the Club. We will delete all this information if we don’t hear back from your parent / guardian within a reasonable time.
3.2 If you are a parent / guardian of an under 13 year old giving permission for the child to join the Club, we will collect the name and email address of the parent / guardian and child, the child’s character name and password.
3.3 If you are 13 or over and register for the Club, we will collect your name and email address and date of birth.
3.4 We may receive and store certain technical information automatically when you interact with us such as the internet protocol (IP) address used to connect your computer to the internet.
4. What about cookies?
4.1 We may use cookies. A cookie is a small amount of data that is sent to your browser from a web server and stored on your computer’s hard drive so that the site can remember who you are. A cookie will typically contain the name of the domain from which the cookie has come, the “lifetime” of the cookie, and a value, usually a randomly generated unique number. Cookies cannot read your hard drive. Usually you can modify the settings of your browser to accept or reject all cookies or be notified when a cookie is set. To view your security settings in Internet Explorer, access the Internet Options within the tools menu in your browser and select the Privacy tab to choose a privacy setting for the internet zone you are in.
4.2 As do many other sites, we may use third party advertisers and/or internet advertising companies working for them to fill ad space on our site (or may do so in future). 5.1 We use your personal information to provide our services e.g. to send Club newsletters with news updates about the site, details of competitions, writing tips etc.
5.2 We use your personal information to help us communicate with you effectively should you try to contact us via our site including verification of any claims you may make.
5.3 If you have agreed on our site or otherwise, we may use your personal information to send you emails (or other communications) with details of our or third party goods or services which may be of interest to you including information about special offers or promotions.
5.4 We may use Google Analytics to measure and analyse our web traffic anonymously.
5.5 We may access, remove, alter or store or otherwise use any personal information if we think you have or may have breached our terms and conditions or to enforce our rights or protect the public or where if we are required to do so by law or appropriate authority.
6. How do we protect personal information?
6.1 Security is a high priority. We take appropriate precautions to protect personal information from loss, misuse, unauthorised access or disclosure, alteration or destruction using the same safeguards as we use for our own proprietary information
6.2 Don’t forget that email and other electronic communications are not secure if they haven’t been encrypted. Your communications may pass through servers in a number of countries before they reach us. So we don’t accept responsibility for any unauthorised access to or loss of personal information that stems from a cause beyond our control.
7. To whom do we disclose personal information?
7.1 You will be pleased to hear that we don’t provide your personal information to third parties for marketing purposes.
7.2 We may disclose personal information so far as reasonably necessary:
a) if we think you have or may have breached our terms and conditions or to enforce our rights or protect the public or where if we are required to do so by law or appropriate authority; or
